These Terms of Service (“Terms”) govern your use of the Spotio mobile application (the “App”), operated as a sole proprietorship (“Spotio,” “we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Spotio is a discovery platform that helps customers find nearby street food vendors, view their menus, photos, timings, and location, and save favorites. Spotio is not a food delivery service. All food is purchased directly and in person from the vendor; Spotio is not a party to that transaction.
In this initial phase, all features of the App are free to use. There is no in-app payment or ordering — Spotio does not process payments between customers and vendors.
Customer accounts: you sign in using your mobile number and a one-time password (OTP). You are responsible for keeping your account and OTP access secure, and for the accuracy of the information you provide.
Vendor accounts: vendors register using their mobile number and provide business details, cart information, and menu content. A vendor listing becomes visible to customers only after it has been reviewed and approved by Spotio's admin team.
The same mobile number may be used to hold both a customer account and a vendor account.
The App allows customers to send bulk order enquiries to vendors who have enabled this feature. This is a lead-based enquiry system only — Spotio facilitates the introduction between customer and vendor but is not responsible for order fulfillment, pricing agreed between the parties, food quality, or any dispute arising from a bulk order. Vendors respond to enquiries at their own discretion.
Customers may rate a vendor using a simple star rating. Ratings related to bulk orders are limited to customers who have completed a bulk order with that vendor. Ratings must reflect a genuine experience; fraudulent, manipulated, or abusive ratings are prohibited.
You agree not to:
Vendors retain ownership of the photos, descriptions, and other content they upload, and grant Spotio a license to display that content within the App for the purpose of operating the platform. Spotio may use editorial judgment to feature or highlight listings.
The App uses Google Firebase and the Google Maps Platform to provide core functionality such as authentication, data storage, notifications, and maps. Your use of these features is also subject to Google's applicable terms.
The App is provided on an “as is” and “as available” basis. Spotio does not guarantee the accuracy, completeness, or availability of any vendor listing, menu, pricing, or timing information, and is not responsible for the quality, safety, or legality of food sold by vendors. Spotio is a discovery platform only and is not responsible for the conduct of any customer or vendor.
To the maximum extent permitted by law, Spotio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, your interactions with vendors or customers, or any food purchased as a result of using the App.
We may suspend or terminate your account if you violate these Terms, provide false information, or misuse the App. You may stop using the App and request account deletion at any time by contacting us.
We may update these Terms from time to time, including as new features (such as subscriptions or in-app payments) are introduced in future phases. Whenever we make a change, we will notify you through the App or by updating the “Effective Date” above, so you always know when something has changed. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka.
